TCPA Compliance Statement

SimonIT LLC ("SimonIT," "we," "us," or "our") is committed to full compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and its implementing regulations established by the Federal Communications Commission (FCC). This statement describes how we use automated telephone technology and how we protect consumers' rights.
1. Our Technology
SimonIT provides AI-powered voice agents that handle inbound and outbound calls on behalf of businesses. Our services include automated call answering, appointment scheduling, emergency dispatch, and SMS appointment confirmations. These services utilize artificial intelligence and may constitute the use of an "automatic telephone dialing system" (ATDS) or "artificial or prerecorded voice" under the TCPA.
2. Consent Requirements
For Inbound Calls
When a consumer voluntarily calls a business that uses SimonIT's voice agents, the call is answered by our AI system. At the beginning of each call, our system identifies itself as an AI-powered assistant. By continuing the call after this disclosure, the caller consents to interact with our automated system.
For Outbound Calls and SMS
We only place outbound automated calls or send SMS messages to individuals who have provided prior express written consent. This consent is obtained through:
- Written or electronic agreements that clearly disclose the use of automated calling technology
- Online forms with clear consent language and a conspicuous disclosure
- Verbal consent documented during a prior inbound call where the caller was informed of, and agreed to, future automated communications
Consent is never a condition of purchasing goods or services.
For Marketing Messages
We obtain prior express written consent before sending any marketing or promotional communications via automated calls or SMS. This consent includes a clear and conspicuous disclosure that the consumer agrees to receive automated marketing messages and that consent is not required to make a purchase.
3. Right to Opt Out
You may revoke your consent to receive automated calls or text messages at any time by:
- Replying "STOP" to any SMS message
- Verbally requesting removal during any call with our system
- Emailing us at optout@simonit.com
- Calling us and requesting removal from automated communications
We will honor opt-out requests within 10 business days. Once you opt out, we will not send further automated calls or texts unless you provide new consent.
4. Do Not Call Compliance
SimonIT maintains an internal Do Not Call (DNC) list. We honor the National Do Not Call Registry and all applicable state DNC lists. We scrub our calling lists against DNC registries before any outbound campaign. Numbers on our internal DNC list are permanently excluded from automated outreach unless new express consent is obtained.
5. Calling Hours
We restrict automated outbound calls and SMS to the hours permitted by the TCPA and applicable state laws, generally between 8:00 AM and 9:00 PM in the recipient's local time zone. Emergency service-related communications (such as HVAC emergency dispatch confirmations) may fall outside these hours when initiated by the consumer's inbound request.
6. Call Identification
All outbound calls and SMS messages from our system transmit accurate Caller ID information, including the name and phone number of the business on whose behalf the call is being made. We do not engage in caller ID spoofing.
7. Record Keeping
We maintain records of consent for each individual who receives automated calls or SMS, including the date, time, and method by which consent was obtained. These records are retained for a minimum of five (5) years as evidence of TCPA compliance.
8. Responsibilities of Our Business Clients
Businesses that use SimonIT's voice AI services are responsible for:
- Obtaining proper TCPA consent from their customers before enabling automated communications
- Maintaining their own consent records
- Honoring opt-out requests received through any channel
- Complying with all applicable federal, state, and local telecommunications laws
- Ensuring their use of our platform does not violate the TCPA or any other regulation
SimonIT provides tools and guidance to help our clients maintain compliance, but ultimate responsibility for compliance rests with the business using our services.
9. SMS-Specific Provisions
SMS appointment confirmations and reminders are sent via Twilio. Each SMS includes:
- The business name sending the message
- The purpose of the message
- Instructions to reply STOP to opt out
- A link to this TCPA Statement when sent for the first time
Message frequency varies based on appointment activity. Standard message and data rates may apply.
10. FCC One-to-One Consent Rule
In compliance with the FCC's one-to-one consent rule effective January 2025, we ensure that consent obtained for automated communications is specific to the individual sender (business). We do not share, sell, or transfer consent across businesses. Consent given to one business using our platform does not extend to any other business.
